Deputies found Ozzie Lee McBeath deceased in his home in late November 2015 after receiving a call that a gunshot had been fired on the property. Waddell said at the time that deputies arrived to find the home on fire, and the victim dead. An autopsy found Ozzie Lee McBeath died from a single gunshot wound to the back of the head.

After extinguishing the fire, deputies searched the perimeter of the property, and found Victor McBeath near the edge of the woods behind the house, where he was apprehended without incident.
