Jury seated for Itawamba County capital murder trial

FULTON, Miss. (AP) — The jury is set for Joshua Clark’s second capital murder trial in Itawamba County Circuit Court.

The Northeast Mississippi Daily Journal reports (http://bit.ly/2aLiHHm) state prosecutors and defense attorneys spent one-and-a-half days to pick 12 jurors and four alternates for the trial. The jury, which will be sequestered during the trial that could last more than a week, listened to opening arguments Tuesday afternoon.

The 30-year-old Clark is accused of killing his 4-month-old daughter, Kylie, in January 2008.

During a 2010 capital murder trial, Clark accepted a plea agreement and pleaded guilty to depraved heart murder and was sentenced to life in prison. On direct appeal, that plea was vacated by Senior Circuit Court Judge Thomas Gardner on the grounds of ineffective counsel. Gardner is presiding over the second trial as well.
