Lawyer: Suppress statements in kidnapping death

JACKSON, Miss. — A lawyer for a Louisiana inmate charged with kidnapping and killing an Ohio businessman in Mississippi wants a judge to throw out statements the suspect made after his arrest.

The lawyer says his clients was exhausted and wasn't advised of his rights.

Prosecutors say Darian "Drake" Pierce was advised of his rights before questioning by authorities and also discussed his involvement with a nurse.

Pierce and Ricky Wedgeworth are charged with kidnapping David Cupps from a hotel in Vicksburg, Miss., after escaping from the Louisiana State Police compound in Baton Rouge on March 4, 2011. The inmates were caught in Tennessee on March 14, 2011.

Cupps' body was found in Bessemer, Ala.

The men are charged in U.S. District Court in Jackson with kidnapping resulting in death and other offenses.
