Lawsuit claims that man burned feet on ramp at yacht club

DANVERS, Mass. — Cups of takeout coffee now carry the warning “Contents may be hot” after a New Mexico woman successfully sued McDonald’s after she was scalded at a drive-through window in 1992.

A Rowley man who says he burned the soles of his feet while walking down a metal ramp one day last June has filed suit against a Danvers marina, saying the facility’s owners should have warned him that the metal ramp would be hot on that sunny day.

Norman Pelletier and his attorney, Michael Mahoney of Lynn, say Pelletier suffered second-degree burns on the soles of his feet after walking on the metal ramp at the Danversport Yacht Club on June 18, 2012.

The lawsuit, filed last week in Salem Superior Court, seeks at least $15,000 in damages for alleged negligence by the facility, which is off Route 62.

Mahoney alleges that the yacht club’s management was negligent because it didn’t warn visitors that the ramp might be hot and that the business failed to provide a “reasonably safe” environment.

The lawsuit does not indicate whether Pelletier was wearing shoes at the time or why he was walking on the ramp.

Mahoney did not return calls seeking comment.

Management at the Danversport Yacht Club, which does not appear to have been served with a copy of the complaint yet, according to the case docket, also did not return calls for comment.
